Before using certain areas of the Platform you may be asked to indicate your acceptance of additional special terms and conditions by clicking a button marked "I Accept", "I Agree", "Okay", "I Consent" or other words or actions that similarly acknowledge your consent or acceptance. Any consent so provided by you will be deemed to be valid consent under all applicable laws.
Your use of the Platform is subject to the Terms and Conditions, which may be updated, amended, modified, or revised by us from time to time. The updated Terms and Conditions shall be effective immediately and shall supersede these. We shall not be under an obligation to notify you of any changes to the Terms and Conditions. You shall be solely responsible for reviewing the Terms and Conditions from time to time for any modifications. If you continue to use the Platform and/or Services after the updated Terms and Conditions have been published, it shall be deemed that you have read, understood and accepted the updated Terms and Conditions.
You may access this Platform to avail Trackify — an intelligent asset management platform that monitors your organisation's assets 24×7, triggers relevant alerts instantly, manages software compliance, tracks field agents, and provides real-time analytics to IT teams.
Prowess Enterprise reserves the right to update the Platform and/or Services to introduce new features, enhance existing features, improve user experience and performance. You agree that Prowess Enterprise will be able to provide support services only if you install all updates upon receiving notifications while using the Platform and its Services.
By using the Platform, you affirm that you are at least 18 years of age and are fully able and competent to accept these Terms and Conditions. Registration is available only to persons who can form legally binding contracts. Persons who are incompetent to contract within the meaning of applicable law — including minors, un-discharged insolvents, or persons of unsound mind — are not eligible to use the Platform.
You must register an account on the Platform. When you register, you must: (i) provide accurate and complete information; (ii) promptly update your account information with any new information; (iii) authorise Prowess Enterprise to make any inquiries necessary to verify your account information; and (iv) acknowledge and accept all applicable policies.
You are responsible for safeguarding and maintaining the confidentiality of your account information. You agree not to disclose your account information to any third party and that you are entirely responsible for any and all activities or actions that occur pursuant to the use of your account. You will immediately notify Prowess Enterprise of any unauthorised use of your account.
Your Services may begin with a trial period wherein you may use the Services free of cost. The trial period will last for such period as determined by Prowess Enterprise. If you do not pay the fee at the end of the trial period, your access to the selected plan will finish and all data uploaded or generated during the trial period will be automatically deleted.
Subject to your compliance with these Terms, Prowess Enterprise grants you a limited, non-exclusive, non-transferable license: (i) to view, download and print any content of the Platform solely for your personal and non-commercial purposes; and (ii) to access, modify, edit and download any content to which you are permitted access solely for your use.
You will not use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, transmit, stream, broadcast or otherwise exploit the Platform and Services, except as expressly permitted in these Terms. The Platform and all Intellectual Property Rights vested therein are owned by Prowess Enterprise.
Our Services can be availed as a subscription model by opting for one of the plans available on the Platform. When you choose to avail our Services, you will be billed as per the plan chosen. We reserve the right to alter, modify, suspend or discontinue any terms and conditions associated with the plan including the period, rate, and services included.
For availing certain Services, the User shall pay the fees as per the quotation or price displayed on the Platform and/or third-party payment gateway. The User acknowledges that multiple payment options such as debit/credit card, net banking, and UPI are made available at the time of making a transaction.
Prowess Enterprise reserves the right to amend the pricing or pricing structure from time to time, subject to due notification to the User.
If the subscription availed by the user is a paid plan, the user shall not be eligible for any refund upon cancellation or non-use. Even if you choose not to use your subscription, you will continue to have access to the Service through the end of your current billing cycle.
Any request for change, downgrade or cancellation in any plan prior to the expiry of your current plan will not entitle you to a refund for the whole or part of the subscription.
Please note that if you delete your account, you will lose access to paid time and Services remaining in your account.
You shall not use the Platform for any purpose that is prohibited by these Terms or other rules and policies implemented by us from time to time. You shall comply with all applicable local laws and regulations in connection with your use of the Services.
By way of example, and not as a limitation, you shall not: (i) violate any applicable law, rule or regulation; (ii) infringe on any intellectual property or other right of any person or entity; (iii) engage in threatening, abusive, harassing, defamatory, libelous, deceptive or fraudulent conduct; (iv) impersonate any person or entity; (v) transmit any software virus or other harmful code; or (vi) share any information that may be harmful to minors.
Furthermore, you shall not: (i) impose an unreasonable or disproportionately large load on our infrastructure; (ii) interfere with the proper working of the Platform; (iii) bypass any measures we use to prevent or restrict access to the Platform; (iv) decompile, disassemble or reverse engineer any part of the Platform; or (v) copy, rent, lease, distribute or otherwise transfer any rights you receive hereunder.
You may provide only information that you own or have the right to use. We may only use the information you provide as permitted by our Privacy Policy and applicable law. We will never share your personally identifiable information without your prior permission. Please review our Privacy Policy for more information regarding how we use and disclose your personal information.
We reserve the right to maintain, delete or destroy all information and materials posted or uploaded through the Services pursuant to our internal record retention and/or destruction policies. We will not be responsible in the event of failure of third-party servers or any other factors outside our reasonable control that may cause your data to be permanently deleted, irretrievable, or temporarily inaccessible.
Each Party hereby represents and warrants that it has the legal right, power and authority to enter into, deliver and perform these Terms and Conditions.
Notwithstanding anything contained herein, the User does not have the right to assign any of their rights under these Terms to any other person or organisation.
While availing Services, Users may connect with third-party service providers. Prowess Enterprise is not responsible for, and does not endorse, any third-party services mentioned on the Platform. Any transaction, dealings or communication that the User may have with such third parties are at the User's own risk.
We attempt to be as accurate as possible. However, we do not warrant that descriptions of our content or other content on this site is accurate, complete, reliable, current, or error-free. Your access to the Platform may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities.
Prowess Enterprise shall own all right, title and interest (including patent rights, copyrights, trade secret rights, trademark rights and all other rights throughout the world) relating to any and all inventions, works of authorship, designations, designs, know-how, content of the Platform, and information which are the subject matter of Services.
While rendering Services, Prowess Enterprise may provide Users with certain materials relevant to the Services in the form of audio, video, written and oral content. Such materials shall be the exclusive property of Prowess Enterprise. Users agree not to share such materials with any third party without Prowess Enterprise's written consent.
The User agrees to keep all technical and non-technical information which Prowess Enterprise may have acquired before or after the date of these Terms — including but not limited to business plans, research, technology, financial information, customer lists, marketing plans, software source documents, and any other information designated as confidential — strictly confidential.
Confidential information shall not include information which: (i) was known by the User prior to receiving it from Prowess Enterprise; (ii) becomes rightfully known to the User from a third-party source not under an obligation to maintain confidentiality; (iii) is or becomes publicly available through no fault of the User; or (iv) is required to be disclosed by law or regulation.
Users shall be prohibited from carrying out any illegal acts on the Platform including but not limited to:
Prowess Enterprise shall, upon obtaining knowledge of any such information, be entitled to disable such information and preserve associated records as required under applicable laws.
These Terms of Service are effective unless and until terminated by either you or Prowess Enterprise. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our Platform.
We have the right to temporarily suspend access to the whole or any part of the Services for any reason whatsoever, including technical or operational reasons. We may terminate your usage of the Platform at any time for any reason, including breach of the Terms and Conditions.
Once temporarily suspended, indefinitely suspended or terminated, the User may not continue to use the Platform under the same account, a different account or re-register under a new account. On termination, such User shall no longer have access to data, messages and other material kept on the Platform.
Prowess Enterprise provides you with multiple automatic and/or customised alerts while providing Services. You understand and agree that any alerts provided to you through the Platform may be delayed or prevented by a variety of factors. We will do our best to provide alerts in a timely manner with accurate information. However, we neither guarantee the delivery nor the accuracy of the content of any alert.
THE SERVICES RENDERED ON THE PLATFORM ARE PROVIDED "AS IS" AND "AS AVAILABLE". PROWESS ENTERPRISE MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AND HEREBY DISCLAIMS ALL OTHER WARRANTIES, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY.
PROWESS ENTERPRISE DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE SECURE OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) ANY CONTENT OR SOFTWARE AVAILABLE THROUGH THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS. YOUR USE OF THE SERVICE IS SOLELY AT YOUR OWN RISK.
You shall defend, indemnify, and hold harmless Prowess Enterprise, its affiliates, and each of its employees, contractors, directors, suppliers and representatives from all liabilities, losses, claims, and expenses, including reasonable attorneys' fees, that arise from or relate to: (i) your use or misuse of, or access to, the Services and Platform; or (ii) your violation of these Terms; or any applicable law, contract, policy, regulation or other obligation.
TO THE FULLEST EXTENT PERMITTED UNDER LAW, IN NO EVENT SHALL PROWESS ENTERPRISE BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF BUSINESS, BUSINESS INTERRUPTION, COMPUTER FAILURE, LOSS OF BUSINESS INFORMATION, DEPLETION OF GOODWILL, LOSS OR CORRUPTION OF DATA OR INFORMATION, OR PURE ECONOMIC LOSS, HOWSOEVER ARISING IN CONNECTION WITH THESE TERMS.
Unless such restriction is prohibited by applicable law, you may not bring any claim under these Terms more than thirty (30) days after the cause of action arises.
If the performance of either Party's obligations is prevented, restricted or interfered with by reason of fire, epidemic or pandemic, casualty or accident, strike or labour disputes, war or other violence, or any act or condition beyond the reasonable control of the Parties (each a "Force Majeure Event"), then the Parties shall be excused from such performance to the extent of such prevention, restriction or interference.
The affected Party shall give prompt notice within three (3) days from the date of occurrence of the Force Majeure Event. If performance is suspended due to a Force Majeure Event for a period in excess of thirty (30) business days, the Parties may terminate these Terms without incurring any charges.
These Terms and Conditions are governed by the laws of India. Any action, suit, or other legal proceeding commenced to resolve any matter arising under or relating to this Platform shall be subject to the jurisdiction of the courts at Hyderabad, India.
If any of these terms should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state in which these terms are intended to be effective, then to the extent and within the jurisdiction which that term is illegal, invalid or unenforceable, it shall be severed and deleted and the remaining Terms of Service shall survive, remain in full force and effect and continue to be binding and enforceable.
These Terms and Conditions are the entire agreement and understanding between you and Prowess Enterprise with respect to the Services and usage of the Platform.

In case you require any assistance or support, you may contact our support team via email at support@trackifyassets.com or use the "Help and Support" function on the Platform. Support is provided Monday – Friday between the hours of 10 a.m. – 6:30 p.m. IST (except public holidays).
Prowess Enterprise shall revert to every complaint within 48 hours of receipt and will take best possible efforts to redress the complaint within 30 days of receipt.
